Terms And Conditions For Lucky Draw

This document lays out the Terms and Conditions, which shall be applicable to the lucky draw (hereinafter referred to as "Lucky Draw") sponsored by Minion Ventures Private Limited (hereinafter referred to as "KredX"), wherein the eligible Business shall have a chance to win an iPhone 14 or a staycation as a reward for marketing the products/services of KredX. By participating in the Lucky Draw, the Business(s) fully and unconditionally agree(s) to accept and abide by the terms and conditions of the Lucky Draw as stated hereinafter. The word “Business” as used in this Terms and Conditions. Reference to masculine in this Terms and Conditions shall include the feminine and neuter gender.

General Term and Conditions

2. The Offer will be available only to Businesses of KredX.
3. Participation/availing of the Offer is voluntary and free, subject to these Terms and Conditions.
4. To avail the Offer, the Business concerned needs to register themselves with KredX.
5. The Offer granted under this Campaign cannot be used or redeemed in combination with any other discounts or promotions or vouchers or any other such promotions offered by KredX.
6. KredX reserve the right, at its sole discretion to add/alter/modify/change/vary all or any of these Terms and Conditions, or to extend, withdraw or replace the Offer, either wholly or in part, without prior intimation/notice and without assigning any reason.
7. KredX shall not be responsible or liable in any manner whatsoever for any deficiency or inadequacy in the services rendered by third party vendors who provide staycation or other services as part of the Offers proposed hereunder, including their agents or representatives, and the Business acknowledges and agrees not to hold KredX responsible or liable for, any losses, damages, costs, charges, expenses, claims, actions or demands suffered by the Business or their agents, relatives, etc. (whether direct or indirect), in relation to accessing and/or availing the benefits under the Offer.
8. KredX holds out no warranty and makes no representation about the quality, delivery or otherwise of the goods and services offered by a vendor or service partner of KredX who facilitates availing various benefits, services contemplated as part of the Offer hereunder. Any issue or dispute or claim arising out of or in relation to availing the benefits under the Offer must be resolved by the Business concerned directly with the merchant partner/vendor without any reference to KredX.
9. KredX does not guarantee or warranty or make any representation about the usefulness, worthiness and/or character of the product/service and/or discount or benefit under the Offer.
10. The Offer under the Campaign is not transferable, is not for sale or re-sale nor redeemable for cash.
11. Any applicable taxes must be paid by the Business concerned.
12. Offers will be valid only during the period specified above unless extended by KredX at its sole discretion.
13. The Offer does not guarantee any reservations or admissions at merchant partner’s outlet/staycation location owners who facilitates various benefits contemplated under this Offer and Businesses are advised to contact such merchant partner directly, before visiting or availing of any benefits.
14. The availability of the Offer shall be subject to the terms and conditions stipulated by the respective merchant partner, as applicable from time to time.
15. In case the merchant partner refuses to provide the Offer, despite adhering to all the applicable terms and conditions, please retain the original bill issued by the merchant partner and share the copy of the same with KredX, within 72 (seventy- two) hours of the incident.
16. KredX shall not be liable for any indirect, incidental, and consequential damages/losses or for any loss or damage arising due to force majeure event.
17. In the event of any misuse or abuse of the Offer by a Business or their agents, KredX reserve the right to deny the Offer.
18. In case of any dispute regarding the interpretation of any of the clause or term of these Terms and Conditions, the opinion of KredX shall be final and binding on all parties to the dispute.
19. Any dispute regarding the Offer will be subject to exclusive jurisdiction of courts in Bengaluru, Karnataka.

Specific Terms and Conditions

• Eligibility for and Participation in Lucky Draw
• A Business shall be considered eligible to participate in Lucky Draw only if the Business is successful in generating leads on KredX’s platform during the Festive Season.
• KredX reserves the right to exclude a Business from the Lucky Draw at any time on the grounds of him/her being the subject of criminal investigation or due to misconduct/ misbehave or criminal record or conviction of any crime.
• Employees, agents, and representatives of KredX, its advertising and promotional agencies, suppliers of rewards, material and services related to this Lucky Draw, as well as members of their immediate families (brothers, sisters, children, spouse, and parents) are not eligible to participate in Lucky Draw.
• Businesses will be eligible to win an iPhone14 provided they must be one of the first hundred sign-ups for “The KredX Spark” drive.  
• Each Business shall be eligible to participate only once in the Lucky Draw.

Reward and Procedure of Lucky Draw

• KredX shall conduct the Lucky Draw out of the pool of eligible Businesses. The draw will be conducted once during the Festive Season.
• The winner(s) will be selected through a random raffle draw from the pool of eligible participants.
• KredX shall communicate the winning Businesses either by phone call on their mobile number registered with KredX or by sending e-mail at registered e-mail id of the Business available with KredX, as may be decided by KredX.
• KredX shall not be held liable, if the Business(s) does not receive the information due to the incorrect mobile numbers/ e-mail id.
• No reward will be awarded if any information given by the winning Business is found to be false, incorrect, incomplete, misleading, or forged in the opinion of KredX.
• Decision of KredX will be final and binding with regard to Lucky Draw, and no correspondence will be entertained in this regard.

Miscellaneous

• Mere participation in this Lucky Draw does not entitle a Business to a reward unless all other terms and conditions are fully complied with. Any fraudulent conduct on the part of the Business shall disentitle such Business to receive the reward under this Lucky Draw.
• KredX reserves the right to change, defer, alter, or cancel this Lucky Draw in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of KredX in this regard and in general with respect to this Lucky Draw and the terms and conditions thereto shall be final and binding.
• KredX reserves the right to terminate, modify or extend the date of the Lucky Draw, at any time at its absolute discretion, without assigning any reason whatsoever. All decisions of KredX in respect of the Lucky draw and the Offer therein shall be final and binding.
• KredX reserves the right to disqualify any of the Business/ winning Business if it has reasonable grounds to believe such Business has breached any of the Terms and Conditions. No intimation shall be sent to the Businesses who are disqualified and/or not amongst the winners.
• Any costs or expenses incurred to participate in the Lucky Draw and/or to claim the reward, if any and as applicable shall be solely borne by the Business/ winner Business and KredX shall not be liable for any such costs or expenses.
• This Lucky Draw is not applicable on /available to the residents of the state of Tamil Nadu, as per Tamil Nadu Prize Scheme (Prohibition) Act, 1979, and wherever else prohibited by law in force.
• The iPhone 14 models are subject to availability and may be substituted with an equivalent product based on availability and discretion.
• Please note that Apple is not, directly, or indirectly, related to this contest and it is not a sponsor in the contest.
